ONE OF THE MOST CRITICAL ISSUES ON THE AGENDA: THE FIGHT AGAINST DRUGS

In the fight against drugs, some countries apply a powerful legal mechanism known as the “burden of proof reversal.”

The fundamental aim of this approach is very clear: to eliminate the financial motivation behind the crime.

❓ Why is this important?

Because for the structures involved in drug trafficking, the real attraction for drug barons is the high and secure profits they can make, even if there is a risk of imprisonment.

The fact that others go to prison instead of those caught, or that perpetrators receive punishment but the wealth gained from drugs remains untouched, allows this crime to continue.

⚖️ What does the reverse burden of proof bring?

In countries that implement this system:

▪️ Individuals with serious evidence of committing drug crimes,

▪️ Those found to have committed these crimes systematically and continuously

have all their assets seized by the state.

The individual is then invited to:

👉 “Prove that these assets were obtained through legitimate means.”

✔️ Assets proven to be legitimate are returned.

❌ Those that cannot be proven are confiscated as criminal proceeds.

🎯 What is the outcome?

When expanded asset forfeiture is applied to target the economic motivation behind the crime, the appeal of committing that crime seriously diminishes over time.

Otherwise, unless criminal proceeds are effectively and comprehensively seized,

achieving lasting success in the fight against drug trafficking and similar organized crimes is not possible.
